Umiliazioni e violenze in casa: marito colpevole e contatti ridotti col figlio
Vent’anni da incubo per la moglie e per la prole. Il matrimonio è durato solo grazie al carattere debole della donna. Addebitabile all’uomo, quindi, la rottura della coppia. I brutti episodi tra le mura domestiche giustificano anche la decisione di ridurre al minimo le possibilità di incontro tra il genitore e il figlio più piccolo.
Anni di umiliazioni e di violenze nei confronti della moglie e dei figli. Inevitabile addebitare al marito la crisi della coppia. Legittimo anche gestire con grande cautela il rapporto col figlio più piccolo, affidandolo in esclusiva alla madre e riducendo al minimo i contatti col padre, figura che gli trasmette paura (Cassazione, sentenza n. 22689/2017, Sezione Prima Civile, depositata oggi).
Crisi. Ufficializzata la separazione, i giudici, prima in Tribunale poi in Corte d’appello, sottolineano le responsabilità dell’uomo di casa, che per venti anni ha sottoposto «moglie e figli a violenze e umiliazioni». Il suo comportamento, punito anche a livello penale, ha causato la crisi definitiva della coppia. E la lunga durata del matrimonio è frutto, osservano i giudici, del «carattere debole e passivo» della moglie, che ha provato a «evitare il fallimento di una unione da cui sono nati tre figli».
I soprusi compiuti tra le mura domestiche hanno avuto però ripercussioni anche sul più piccolo dei figli. Non a caso, in Appello il ragazzo viene «affidato in via esclusiva» alla madre, disponendo che «il padre possa vederlo due o tre volte a settimana, senza orari prefissati», proprio secondo «la volontà del minore».
Comportamenti. Ogni obiezione proposta in Cassazione dall’uomo si rivela completamente inutile. Per i giudici, innanzitutto, è lampante che i «comportamenti violenti» a lui attribuiti non siano «presunti», bensì certificati dalle «deposizioni testimoniali dei figli» – sia i due maggiorenni che quello minorenne – e da una «sentenza penale» suo carico di «condanna a tre anni di reclusione» per il reato di «maltrattamenti in famiglia».
Nessun dubbio, quindi, sul fatto che il capofamiglia abbia «inflitto alla moglie e ai figli violenze e umiliazioni, dai primi anni ’90 sino al 2011», e che quegli abusi, fisici, morali e psicologici, abbiano provocato «la crisi del matrimonio».
Su questo fronte i magistrati del ‘Palazzaccio’ ribadiscono che «le violenze fisiche e morali costituiscono violazioni talmente gravi e inaccettabili dei doveri nascenti dal matrimonio» che sono sufficienti, anche a fronte di «un unico episodio di percosse», a dare il ‘la’ alla «separazione» e a renderla addebitabile all’«autore delle violenze».
E questa ottica rende anche comprensibile la scelta dell’«affidamento esclusivo» del figlio minorenne alla madre. Decisivo il fatto che il ragazzo si rapporti con timore alla figura paterna, proprio alla luce dei soprusi verificatisi in famiglia ad opera del genitore.
